Why It Exists — The Opposition Window
Under Section 21 of the Trade Marks Act, 1999, publication gives the public — including competitors and existing trademark owners — formal notice of a pending mark. This opens a 4-month opposition period, during which anyone who believes the mark conflicts with their rights can file a Notice of Opposition.
If no opposition is filed within this window, the mark proceeds to registration. If an opposition is filed, the case moves into contested proceedings before the Registrar.
