What is Form TM-A? — Definition
Form TM-A is the prescribed application form used to file a new trademark in India — whether it's a word mark, logo, sound mark or any other type. Before the Trade Marks Rules, 2017 came into force, applicants had to use different forms (TM-1, TM-2, TM-3, TM-4) depending on the situation. All of these were consolidated into the single Form TM-A.

Where It's Defined
Form TM-A is prescribed under the Trade Marks Rules, 2017, framed under the Trade Marks Act, 1999. It is filed electronically through the IP India online portal, or physically at one of the five Trade Marks Registry offices (Delhi, Mumbai, Kolkata, Chennai and Ahmedabad).
What Form TM-A Requires
- Applicant detailsName, address, and type of entity (individual, proprietorship, company, LLP, etc.)
- Representation of the markA clear image or representation of the word, logo, or other mark being applied for
- Class and specificationThe trademark class (1–45) and a description of the specific goods or services covered
- Date of first use, if claiming prior useOr a "proposed to be used" declaration if the mark hasn't been used commercially yet
- Power of AttorneyForm 48, if the application is filed through a trademark agent or advocate
What Happens After Filing
Once Form TM-A is submitted, an application number is generated — usually within 1–2 working days — after which the ™ symbol can be used. The application then proceeds through examination, and if accepted, publication in the Trademark Journal for opposition purposes, before final registration.
E-filing Form TM-A on the IP India portal costs 10% less than filing it physically at a Registry office, and reduces processing delays significantly.

Frequently Asked Questions
Is Form TM-A the same as "applying for a trademark"?
Yes. Filing Form TM-A is the formal act of applying for a trademark in India — it is the only application form used for new trademark filings since the 2017 Rules came into effect.
How much does it cost to file Form TM-A?
The government fee depends on the applicant type — individuals, startups and small enterprises pay a reduced fee (currently ₹4,500 per class for e-filing) compared to other companies (₹9,000 per class for e-filing).
Can I file Form TM-A myself without a lawyer?
Yes, it's legally possible to self-file. However, incorrect classification, weak specification of goods, or missing a prior conflicting mark are common self-filing mistakes that lead to objections or oppositions later — professional review before filing reduces this risk significantly.
What happens if I make an error on Form TM-A after filing?
Certain corrections can be made through Form TM-M (miscellaneous applications), but material changes — such as to the mark itself — generally cannot be made after filing and may require a fresh application.
What is the difference between Form TM-A and Form TM-M?
Form TM-A is used only to file a new trademark application. Form TM-M is a general-purpose miscellaneous form used for a wide range of post-filing requests — such as correcting an address, requesting an expedited examination, or making other administrative changes to an existing application or registration.
