Every line of code you write, every function you design, every mobile app or web application you build is protected by copyright the moment it is created. Yet most software developers and tech startups in India either do not know this, do not register it, or do not take the steps needed to actually enforce it when their code is copied. This guide explains how copyright protects software in India, why registration matters and what to do when your code is stolen.

Copyright in Software Arises Automatically

Under the Copyright Act, 1957, computer programmes are expressly included in the definition of "literary works" (Section 2(o)). This means your source code, object code, application code, database schema and even the visual elements of your user interface are protected by copyright from the moment they are created in a tangible form โ€” without any registration requirement.

This protection applies to:

  • Source code and object code
  • Mobile applications (Android, iOS)
  • Web applications and websites
  • APIs and backend code
  • Databases and data structures (if original)
  • Software documentation and technical manuals
  • User interface design elements

What Copyright Does Not Protect

Copyright protects the expression of an idea โ€” the specific code you wrote โ€” not the underlying idea, algorithm, concept or functionality itself. This is a critical distinction:

  • Copyright protects: the specific lines of code you wrote
  • Copyright does NOT protect: the concept of what the software does, the algorithm it uses (that may be patentable), or the general approach

A competitor can legally write their own code that does the same thing as yours, as long as they do not copy your actual code. Should You Register Your Software Copyright?

Copyright registration in India is not mandatory, but it is strongly recommended for software, for several important reasons:

  • Prima facie evidence: A registration certificate is accepted as prima facie evidence of ownership in court โ€” significantly reducing the evidentiary burden in infringement disputes
  • Deterrence: A registration creates a public record that your software is yours, which can deter potential infringers
  • International protection: India is a member of the Berne Convention. A registered copyright in India facilitates enforcement in other Berne Convention member countries
  • Investor and partner confidence: A copyright certificate provides documented proof of IP ownership during due diligence for investment or partnership deals

Who Owns the Copyright in Software?

This is one of the most frequently misunderstood questions in software IP:

  • If an employee writes code as part of their employment, the copyright belongs to the employer โ€” not the employee โ€” under Section 17 of the Copyright Act
  • If a freelancer or contractor writes the code, the copyright belongs to the contractor unless there is a written agreement explicitly assigning the copyright to the client. Many startups have been surprised to discover that the code written by their outsourced developer technically belongs to the developer, not to them
  • If code is written by a co-founder, copyright belongs to that individual unless assigned to the company

⚠️ Action required: If you have engaged any freelancer, contractor or agency to write code for your business, check whether you have a written assignment of copyright. If you do not, the developer may technically own the code you are running your business on. This must be rectified with a proper IP assignment agreement.

What to Do When Your Code Is Copied

Software copyright infringement is increasingly common, particularly with the ease of copying digital files. If you discover that someone has copied your code:

  • Document the infringement โ€” preserve copies of the infringing software, screenshots and any evidence of copying
  • Conduct a code comparison analysis โ€” in cases involving substantial code copying, a technical expert can prepare a comparison report
  • Send a cease-and-desist notice demanding the infringer stop using the code and remove it from their products
  • File a civil suit for copyright infringement โ€” the court can grant injunctions, order damages and require delivery up of infringing materials
  • File a criminal complaint under Section 63 of the Copyright Act โ€” copyright infringement is a cognisable offence carrying imprisonment of 6 months to 3 years and a fine
